I have a criminal charge. What can I expect on my first court date? On your first appearance court date, the Crown will give their Disclosure (evidence of the charges against you). In most cases, a second appearance date is scheduled approximately 4 weeks later. This is for the accused to seek legal counsel and review the Disclosure.
What is an "Appearance" date? Each court date is referred to as an Appearance. After several appearances, the desire for the matter to be resolved increases by the court (ex- set a trial date/ enter a plea)
What is an "Adjournment"? When the Court adjourns a matter to another date, this is simply scheduling another date (or appearance). The Court does this where time is needed to address issues within the case. For example- review disclosure, retain a lawyer, schedule a plea/trial date, mediate family court matters or any unforeseen circumstances that may arise. The Court has discretion to adjourn a matter based on a variety of issues.
I have received summons for jury duty. How can I avoid serving as a juror? The court requires citizens to serve as jurors to administer proceedings in criminal court. On the day you are required to attend, substantial reasons may excuse a person from jury duty. These typically include health concerns and loss of income for self employed individuals. If the reason given is not deemed extraordinary, you may be subject to this process and be chosen to serve as a juror.
I have received/ served Family Court documents. What can I expect at my court date? The Mandatory Information Program is an online tutorial for those beginning Family Court proceedings. Matters including divorce, custody and property are explained in this program. The Court requires completion of this program by both parties prior to your first appearance in court.
I cannot afford a lawyer, and I make too much money to obtain Legal Aid. What should I do? Unfortunately, there are a lot of people that are in this situation. The Family Law Information Centre (FLIC) office within the Ontario Superior Court of Justice is very helpful, and have lawyers on site that can give legal advice. Be patient, as there are usually several people waiting there turn for legal advice. At your court date, sign up for Duty Counsel as soon as possible.
